Inside US lawsuit: How Apple, publishers allegedly brought Amazon to heel

US antitrust lawyers filed a lawsuit against Apple Inc. and two publishers, alleging they conspired to inflate the price of e-books, at an estimated cost to readers of $100 million.

Antitrust lawyers at the Department of Justice filed a civil lawsuit Wednesday charging Apple Inc., and two of the nation?s largest book publishers with conspiring to artificially inflate the price of e-books.

The antitrust suit was filed in federal court in New York, where three other publishers agreed to settle the same charges.

In an alleged plot that could easily rival best-selling tales published by the defendant companies, prosecutors say the five book publishers conspired over a four-year period with Apple in an attempt to force online retail giant Amazon to stop charging a deeply discounted $9.99 for new e-books.

Estimates are that the alleged plot cost readers $100 million in inflated e-book prices.

?During regular, near-quarterly meetings, we allege that publishing company executives discussed confidential business and competitive matters ? including Amazon?s e-book retailing practices ? as part of a conspiracy to raise, fix, and stabilize retail prices,? Attorney General Eric Holder told reporters in Washington.

?With today?s lawsuit, we are sending a clear message that competitors, even in rapidly evolving technology industries, cannot conspire to raise prices,? added Sharis Pozen, acting assistant attorney general in charge of the Justice Department?s antitrust division.

?We want to undo the harm caused by the companies? anticompetitive conduct and restore retail price competition so that consumers can pay lower prices for their e-books,? she said.

The lawsuit is the result of cooperation between the Justice Department?s Antitrust Division and the European Commission. The attorneys general of Connecticut, Texas, and 13 other states also played a role in the investigation.

In addition to Apple, the publishers named in the pending suit are Macmillan and Penguin Group, both based in New York City.

Hachette Book Group, HarperCollins, and Simon & Schuster, all New York-based, have agreed to settle the lawsuit and end anticompetitive practices alleged by the government.

The alleged conspiracy revolved around the emerging market for e-books and a perceived threat to the future of the book publishing business as it presently exists.

Publishing executives were worried that Amazon?s deep-discount pricing of e-books might significantly undercut their ability to continue to sell hardcover books for $25 or more.

In addition, they worried that if e-books became too popular, upstart digital publishers ? including Amazon itself ? might enter the e-book industry and push the long-dominant publishers aside, according to court documents.

?Amazon?s move threatened the publisher defendants? traditional positions as the gate-keepers of the publishing world,? the suit says.

To rein Amazon in, the suit says, executives from the five book publishers decided to change the way they sold their books to book retailers.

Under the old rules, retailers purchased the books at a wholesale discount off the publisher?s list price. The retailers were then free to set their own bookstore prices after that.

Thankfully, Sony saw fit to include a full multi-touch display this time around instead of the awkward edge-only navigation scheme seen in the SmartWatch's forebear.

Cory Booker, Newark Mayor, Saves Neighbor from Burning Home


Forget a suit. Newark Mayor Cory Booker should wear tights and a cape to work.

The politician is in the news today because he rescued a neighbor from her burning house last night, entering the residence against the advice of his security team, carrying the young woman through flames and suffering second-degree burns in the process.

"I actually wasn't thinking," Booker said on CBS This Morning, detailing how he jumped through the kitchen window and: "When I got there and couldn't find her in all the smoke, looked behind me and saw the kitchen really erupting with flames all over the ceiling, that's when I had very clear thoughts that I'm not going to get out of this place alive and got... very religious.

"It is a very, very scary thing. And I'd like to say that I, at that point I was feeling so courageous, but honestly, it was terrifying, and to look back, you can see nothing but flames. Look in front of you see nothing but blackness."

Booker eventually tracked down the lady because she started yelling, he explained, and proceeded to head back out the burning kitchen, where he handed her off to Newark Police Detective Alex Rodriguez.

"I feel very blessed," Booker said. "As the fire director told us, anything could have happened… Yesterday, all my problems were really big to me. Today things feel a lot more clear. And I have a lot more respect for firefighters!"

Booker suffered the aforementioned burns, along with smoke inhalation. The woman also suffered second-degree burns on her back - but she is alive to talk about it, thanks to her mayor.

Nasa man rejects coal-fired power

NASA climate change scientist Dr James Hansen tells BBC Scotland the UK should not build any more coal-fired power stations

A world climate change expert has said the UK should not build any more coal-fired power stations.

Nasa scientist Dr James Hansen was speaking to BBC Scotland ahead of being awarded the prestigious Edinburgh Medal at the city's Science Festival.

Plans have been put forward for coal-fired facilities at Grangemouth and Hunterston in Ayrshire.

Dr Hansen said a mixture of new-build nuclear and renewables was the best combination to prevent climate change.

Speaking on Newsnight Scotland he said: "For base load electric power, I think that we need next generation nuclear power, which can be much safer and which can burn nuclear waste and solve that major problem with nuclear power."

Last month it emerged that US firm, Summit Power Group, is planning to build a coal-fuelled power station at the port of Grangemouth, on the Firth of Forth.

The plant would use carbon capture and storage (CCS) technology in a bid to reduce emissions by more than 90%.

A public inquiry is due to be carried out before the Scottish government makes a final decision on proposals for a similar facility at Hunterston.

In November last year North Ayrshire Council rejected plans by Ayrshire Power for a coal-fired station but company vowed to fight on.

WeTopia Brings Social Good to Facebook Gaming

Sojo Studios wants to democratize philanthropy, and it has tapped into the enormous social gaming population ? which is expected to reach 68.7 million players by year?s end according to a report by analysis firm eMarketer ? to do just that.

The company?s WeTopia, a free Facebook game that turns players? points into monetary donations for children?s charities, has roped in 800,000 players since November and is already impacting the world offline. By the end of May, players? in-game actions will have accomplished the following:

  • Built two schools for more than 400 children.
  • Funded an after-school program in Kentucky and a mobile health clinic in New York.
  • Donated 1 million gallons of water, 650,000 meals, 2,000 multi-vitamin doses, 2,500 shoes and 4,000 coats.

?We felt that if we could harness the power of millions of players already playing social games, and give them a way to work together and give back, it could change the landscape of gaming,? Lincoln Brown, founder and CEO of Sojo Studios, tells Mashable.

In the game, players control virtual villages by building homes, tending to crops and sometimes working with Facebook friends to advance to new levels or earn more ?JOY,? which are the points players use to donate to specific charitable projects in the real world. Players also can buy Facebook Credits to purchase virtual goods.


Sojo Studios, a privately-held company that generates revenue via advertisers and paid virtual goods in WeTopia, has donated 50% of its profits to 20 partnered charities and 501(c)(3) non-profits such as Action for Healthy Kids, buildOn, Save the Children, Children?s Health Fund and Stop Hunger Now.

The game?s social good component ? dubbed ?Play for Good? ? has attracted celebrity support from Ellen DeGeneres and Justin Bieber, in addition to nabbing advertising partnerships with Mattel and Clorox.

?The idea to ?Play for Good? is working because players have a positive reason to play social games ? they no longer feel guilty for spending their time gaming online,? Brown says. ?We are having a real impact in the lives of children around the world because of their efforts.?

Players can track the projects they?re helping by clicking on the ?Real Impact? tab within the game. There, they can a world map of the projects and statistics on donations (see image at left).

The idea for the game came after the 2010 earthquake in Haiti, which Brown saw as an opportunity to ?meaningfully disrupt philanthropy.?

?We wanted to create ways for small donors to support and engage with causes as part of their everyday lives, not as one-off donations where donors get little to no genuine transparency around their efforts,? Brown says.

I joined the Blank Page Screenwriter?s Workshop in 2009 and ?nally got my muse in gear. I?ve since written a three part epic fantasy mini-series, a feature, and half a dozen shorts. I also now have more than 20 credits on IMDB as a Writer, Producer, Director, Director of Photography, Editor, Assistant Director, Actor, and as various other roles.

My last project was a ?lm short called ?The Rubicon.? I was the Writer, DIrector and Editor and I also played a supporting role. It is on the festival circuit now and so far it has won awards from the ?Best Shorts Competition,? the ?Indie Fest Awards? and the ?Accolades Competition.?

I plan to shoot at least two more shorts this year and am always keeping an eye out for talent to use in future productions. I have my own production company, Bright Forest Productions LLC in Roswell. I shoot with a Sony EX1 and Canon 60D and have a full Final Cut Studio edit suite. I am also an Apple Certi?ed Colorist and Editor.Recently I have started a new venture to try and bring some credibility to the whole
?festival/competition? circus.

Jury being seated in Hudson family murder trial

CHICAGO (AP) ? The final four jurors were to be selected Tuesday for the Chicago trial of the man accused of killing three of actress and singer Jennifer Hudson's family members.

Fourteen people were selected Monday to be among the 12 jurors and six alternates after nine hours of interviewing potential jurors one by one. Cook County Circuit Judge Charles Burns and attorneys were looking to weed out anyone who might be swayed by the 30-year-old Hudson's celebrity.

William Balfour, 30, is charged with murdering Hudson's mother, brother and nephew in 2008, and faces a maximum life prison sentence if convicted.

Hudson's name came up frequently during Monday's questioning of potential jurors, though most insisted that despite what they knew about her or heard in the media about the case, they could consider only the evidence presented at the trial. Testimony begins April 23.

One woman in her 30s, a salesperson at Xerox, was dismissed Monday after she told those assembled, including Balfour, that she is a fan of Hudson's and would be unable to give the defendant a fair trial.

Only a few people said they knew little to nothing about Hudson. One woman in her 30s picked for the jury said she had heard of Hudson but had no idea what she looked like.

Among those selected to serve on the panel were several people who said they had relatives who were murdered and a man who said that 25 years ago, an attacker grabbed his sister's purse at a bus stop and slashed her throat, badly injuring her.

Also chosen were a Mexican-American truck driver who said he sometimes has trouble speaking English, an unemployed women who lives three blocks from the courthouse and a customer representative at a chocolate company who responded when asked about her hobbies that, "I like to sleep, then I like to eat, then I sleep again."

Among those dismissed were a man whose neighbors were police and FBI agents, a Chicago school teacher who was once a character witness for a student charged with murder, and an unemployed widow whose nephew recently killed his pregnant wife.

"It's way too close to home," she said when asked if she could hear the Balfour trial dispassionately. "It's just that there's a child involved, and I can't get past that."

Hudson, who was not in Chicago at the time her family members were killed, told investigators she was in touch with her mother almost every day and became concerned when she couldn't reach her by late morning on Oct. 24, 2008.

Hours later, the bodies of her mother, Darnell Donerson, 57, and brother, Jason Hudson, 29, were found shot to death in the family home. The body of her 7-year-old nephew, Julian King, was found days later in an SUV several miles away.

Balfour's lawyers have said the evidence is circumstantial. But prosecutors say the proof includes gun residue found on his car's steering wheel, and that testimony will show he lied about his whereabouts the day of the killings.

ZURICH (AP) - World champion Spain remained No. 1 in FIFA's monthly rankings while Uruguay rose to a new high of No. 3. The United States fell two places to No. 29.

The Netherlands dropped two spots to No. 4. Germany advanced to No. 2 despite not playing since beating England 3-2 in an exhibition in February.

Copa America champion Uruguay has not played since the March rankings were calculated. It rose because the rankings reflect all international results over a rolling four-year period.

Portugal climbed two places to No. 5, overtaking England and Brazil. The Italians dropped from the top 10, with Denmark replacing them at No. 9.

No. 15 Ivory Coast is the highest-ranked African team. Mexico still leads CONCACAF nations after rising to No. 20. Australia, at No. 21, leads Asian confederation nations. No. 130 New Zealand leads Oceania.

Raise property tax to fund urban infra: Panel - Think India Foundation

New Delhi : An expert committee in the urban development ministry has recommended an increase in property taxes as a step to finance urban infrastructure during the 12th five-year Plan. A report by the committee has estimated Rs 40,000-50,000 crore would be required for over a period of less than 20 years.

"Marc, Quick question please: Have you noticed an excess number of shoulder injuries and shoulder surgeries? I was in OKC to watch the WCWS (4th year attending)?and talked with another coach from Mississippi that?told me he sees the same thing.? An awful lot of?players with shoulder injuries. If so, what do you attribute to this? 50+ weeks a year work and overuse?? Improper stretching along with improper throwing mechanics? One thing is for sure,? this needs to be addressed at? a national level and coaches need to be educated to? ensure our young female athletes are not damaging? their shoulders and requiring surgery as an expected? part of playing softball! I did like the note ref Jaeger's Long Toss, Arm Circles?and J Bands warm-ups before throwing.? I'll have to get?quite a few coaches to tell me they are already using this type warm-up before throwing, as I'm sure my coaches will be reluctant to change unless it?s well known?in the community.

It is due to many factors:

1) Uni-dimensional athlete

The modern day softball player isn't an athlete anymore;?she is just a good softball player.

By that I mean that?nowadays, kids specializes in one sport (softball) too
early and don't participate in other sports. This results in poor overall athletic development, muscular imbalances and overuse of certain muscles (throwing) because of
repetitive use.

2) Improper throwing mechanics

We don't spend enough time reinforcing proper throwing mechanics and many kids end up overcompensating with other muscles which create problems over time.

3) Improper conditioning

Lack of stability, flexibility, and strength in certain muscles will cause problems and lead to overuse injuries. The shoulder is an especially complex and fragile joint.

4) Improper warm-up

A simple small tear one time because of a poor or rushed warm-up is enough to lead to a major should overuse injury that will last months and even longer. The warm-up is
absolutely crucial.

5) Overuse

If you do too much softball without ever giving your body a break, eventually it will break down.

So, what do you need to do to prevent shoulder injuries?

1) Ensure proper overall athletic development
2) Give your break a rest
3) Always warm-up thoroughly, especially the shoulder
4) Fix and optimize throwing mechanics
5) Use shoulder injury prevention exercises
6) Pay attention to any sign or symptoms of shoulder
injuries and seek medical attention early
7) Never ever play through shoulder pain

San Francisco, April 9, 2012 Through the course of her career, Barbara Romanowicz has studied the Earth from its surface to its center, establishing herself as one of the most influential seismologists of her time. For her outstanding contributions in seismology and earthquake engineering, the Seismological Society of America (SSA) will award Romanowicz with its top honor, the Harry Fielding Reid Medal, at its annual meeting on April 17 in San Diego, Calif.

Since Romanowicz's early work on seismic tomography that resulted in the first regional scale models of the mantle beneath North America, her research has been on the cutting edge of seismology.

Romanowicz, who is a professor at the University of California, Berkeley and holds the chair of Physics of the Earth's Interior at Collge de France, in Paris, has made fundamental contributions to practically all areas of global seismology, from body-wave studies of the anisotropic and anelastic structure of the inner core, to normal-mode studies of the Earth's density distribution and surface- waves studies of the upper mantle.

Her contributions are not only reflected in the area of research, but also in her service to the seismology community. While still at the Institut de Physique du Globe in Paris (IPGP) in the early 1980s, she was instrumental in the conception and development of GEOSCOPE, a worldwide network of seismological observatories from which high quality data are openly available.

After arriving at UC Berkeley in 1991, she has revived its Seismological Laboratory, which she directed from 1991 to 2011, leading it to be one of the best in the world. The lab plays a critical role in seismic monitoring and nurtures cutting edge research in seismology and geodesy. It serves as an important link in the seismological infrastructure of the west coast of the United States.

Romanowicz has published more than 180 papers and has been honored by leading European and American geophysical organizations. She is a Fellow of the American Academy of Arts and Sciences and Member of the National Academy of Sciences.

Science & the Public: Bat killer is still spreading

New federal grants will expand the search for vulnerabilities in the fungal pathogen and potential treatments for affected bat populations.

Since 2006, some 6 million to 7 million North American bats have succumbed to white-nose syndrome, a virulent fungal disease. That figure, issued in January by the U.S. Fish & Wildlife Service, at least sextupled the former estimate that biologists had been touting. But the sharp jump in the cumulative death toll isn?t the only disturbing new development. On April 2, scientists confirmed that white-nose fungus has apparently struck bats hibernating in two small Missouri caves.

The finding brings to 19 the number of states impacted by the fungus. It also marks the first confirmation that the pathogen is causing clinical disease west of the Mississippi.

The good news, at least for now: No bat deaths have been attributed to the disease in Missouri, says bat biologist Tony Elliott with the state?s Department of Conservation. But his team?s new announcement brings to three the number of infected caves within the state. It also puts wildlife managers on high alert that area bats may be in peril.

Potentially more troubling, North American bats are not the only ones in the cross-hairs. Earlier this year, researchers in the Czech Republic reported the first European case of clinical disease caused by the fungus responsible for white-nose syndrome. The live victim was a male greater mouse-eared bat that had been hibernating in a cave at a site known as By?? sk?la.

Responding to the European case: ?It?s not a surprise, but we don?t know what it means,? says Jeremy Coleman, a U.S. Fish & Wildlife Service biologist who serves as national white-nose-syndrome coordinator. It could be the animal was weakened and more vulnerable to the ubiquitous fungus than its hibernating kin. It could be a sign that some strains of the fungus in Europe are especially virulent. Or, he observes, it might simply signal that many Euro bats develop mild disease, only to recover ? in sharp contrast to their cousins across the Atlantic.

The fungus responsible, a relatively newly identified species known as Geomyces destructans, has been racing through colonies of hibernating North American bats since?at least?the winter of 2005. Last year, data emerged indicating the same fungus inhabits caves and other sites where bats hibernate in Europe ? and probably has been part of their ecosystems for hundreds of years, if not millennia.

This has led ecologists to suspect that the disease striking American bats traces to a recent European ?migr?.

Until now, the fungus attached itself to European bats but caused no apparent harm. The likely reason: Either the European fungus is weaker than the American strain, or ? and more likely ? European bats co-evolved with the fungus and gradually became resistant to it. (That's certainly one interpretation of a study released April 9 on hibernating bats experimentally?exposed to each strain of the fungus: It found the European strain was more virulent, which would be one response of a?fungus that evolved?to successfully continue to infect heavily resistant bats.)

What?s new in the Czech study, explains pathologist Carol Meteyer of the U.S. Geological Survey?s National Wildlife Health Center in Madison, Wisc., is the confirmation of tissue damage characteristic of clinical white-nose sydrome: skin being digested by the pathogen as the fungi?s fibrous segments enter a bat?s wing and begin replacing its cells.

The big concern: Might the Czech data point to a crack in European bats? armor against the fungi?

On April 6, the U.S. Fish and Wildlife Service issued seven new grants averaging $500,000 each to research teams studying white-nose syndrome. ?It?s our top priority to understand the bats? susceptibility and resilience,? Coleman says. Such research projects are important, he says, to establish whether nascent signs of recovery in a few early-hit North American hibernating sites are anomalous, are signs that some bats are developing immunity to the fungus ? or merely represent stragglers that the fungus has yet to find.

Virus hit Missouri in 2010
Two years ago, Missouri biologists surveying caves and other sites where animals hibernate saw signs suggesting the presence of white-nose fungus on resting bats. They collected little bits of the fungus?and sent the material to the National Wildlife Health Center where one of Meteyer's colleauges conducted a genetic-fingerprinting analysis. It tested positive for Geomyces destructans.

But fungus on a bat's fur does not?itself constitute disease. For that, Meteyer explains, microscopic analyses of skin tissue must confirm that the pathogen "is eroding it ? actually eating away the skin of?the bat." Back in 2010, her center lacked the tissues for such analyses.

In the mean time, Missouri stepped up its surveys of bat-hibernating sites. This March it found signs of white-nose infected animals in two small caves ? one hosting fewer than 10 bats and the other?with around 60. Elliott says they collected a little brown bat from one cave and tricolored bats from a second. After euthanizing, the animals were shipped to Meteyer where she confirmed disease was present in both species of bats.

She also cautions that diagnosing the disease can be challenging. Her lab makes definitive assessments of white-nose syndrome, and lately some specimens have arrived?that at least initially?had?a surface coating of a white-nose-like fungus. But it was a benign?imposter, she notes. And the rub for those scouting signs of the bat pandemic's spread: "You cannot distinguish those [benign fungi] from white-nose syndrome just by looking at the bat in the cave."

Apple's 'iPad' is the only tablet people know

NEW YORK (AP) ? Apple is on the verge of doing what few others have: change the English language.

When you have a boo-boo, you reach for a Band-Aid not a bandage. When you need to blow your nose, you ask for Kleenex not tissue. If you decide to look up something online, you Google instead of search for it. And if you want to buy a tablet computer, there's a good chance there's only one name you'll remember.

"For the vast majority, the idea of a tablet is really captured by the idea of an iPad,'" says Josh Davis, a manager at Abt Electronics in Chicago. "They gave birth to the whole category and brought it to life."

Companies trip over themselves to make their brands household names. But only a few brands become so engrained in the lexicon that they're synonymous with the products themselves. This so-called "genericization" can be both good and bad for companies like Apple, which must balance their desire for brand recognition with their disdain for brand deterioration.

It's one of the biggest contradictions in business. Companies spend millions to create a brand. Then, they spend millions more on marketing that can have the unintended consequence of making those names so popular that they become shorthand for similar products. It's like if people start calling station wagons Bentleys. It can diminish a brand's reputation.

"There's tension between legal departments concerned about 'genericide' and marketing departments concerned about sales," says Michael Atkins, a Seattle trademark attorney. "Marketing people want the brand name as widespread as possible and trademark lawyers worry ... the brand will lose all trademark significance."

It doesn't happen often. In fact, it's estimated that fewer than 5 percent of U.S. brand names become generic. Those that do typically are inventions or products that improve on what's already on the market. The brand names then become so popular that they eclipse rivals in sales, market share and in the minds' of consumers. And then they spread through the English language like the common cold in a small office.

"There's nothing that can be done to prevent it once it starts happening," says Michael Weiss, professor of linguistics at Cornell University. "There's no controlling the growth of language."

FIGHTING BACK

A company's biggest fear is that their brand name becomes so commonly used to describe a product that a judge rules that it's too "generic" to be a trademark. That means that any product ? even inferior ones ? can legally use the name. A brand usually is declared legally generic after a company sues another firm for using its name and the case goes to a federal court.

Drug maker Bayer lost trademarks for the names "aspirin" and "heroin" this way in the 1920s. So did B.F. Goodrich, which sued to protect its trademark of "zipper" in the 1920s after the name joined the world of common nouns. Similar cases deemed "escalator" generic in 1950, "thermos" generic in 1963 and "yo-yo" generic in 1965.

It's difficult to quantify how much revenue a company loses when its brand is deemed generic. But companies worry that it breeds confusion among consumers.

To prevent their names from becoming generic, some companies use marketing to reinforce their trademarks. For instance, after its Band-Aid brand name started becoming commonly used to refer to adhesive bandages, Johnson & Johnsons changed its jingle in ads from "I'm Stuck on Band-Aid" to "I'm Stuck on Band-Aid brand."

Kleenex uses "Kleenex brand" instead of just "Kleenex" on its packaging and in marketing and places ads to remind people Kleenex is trademarked. And the company contacts some people who use Kleenex generically to refer to tissue in order to correct them.

"We've worked very hard to keep 'Kleenex' from going the route of 'escalator' and 'aspirin,'" says Vicki Margolis, vice president and chief counsel, intellectual property and global marketing for Kimberly-Clark, which owns Kleenex. "If we lose the trademark, people can use it with sandpaper and call that a Kleenex."

Xerox is taking a similar route. The company, which introduced the first automatic copier in the U.S. in 1959, has been on a public crusade for decades to keep its brand from becoming generic. The machine's success has led people to start using "Xerox" to refer to any copying machine, copies made from one and the act of copying.

"In the mid- to late-1970s, we ran dangerously close to Xerox becoming 'genericized,'" says Barbara Basney, vice president of global advertising. "That prompted a lot of proactive action to protect our trademark."

Xerox has spent millions taking out ads aimed at educating so-called "influencers" like lawyers, journalists and entertainers about its brand name. A 2003 ad said: "When you use 'Xerox' the way you use 'aspirin,' we get a headache." More recently, a 2007 ad read: "If you use "Xerox" the way you use "zipper," our trademark could be left wide open."

While people still use "Xerox" generically ? the Merriam-Webster dictionary lists the word as both a lower-case verb with the definition "to copy on a xerographic copier" and a trademarked noun ? the brand says its campaign has been a success.

Xerox is still popular: It's ranked the 57th most valuable global brand, worth $6.4 billion, according to brand consultancy Interbrand. And perhaps most importantly, Xerox hasn't lost its trademark.

TAKING IT IN STRIDE

Sometimes companies embrace when their brands become common nouns.

Perhaps the best example of this is Google, a company created in 1998 when Alta Vista and Yahoo.com were the top online search engines. Google, which created a formula that returned more accurate results than its competitors, became so popular that people began saying "Google" to refer to a Web search, in general. Experts say Google has benefited from its name becoming a part of the lexicon.

"You don't say 'Why don't I Google it' and go to Yahoo or Bing," says Jessica Litman, professor of copyright law at the University of Michigan Law School, referring to other search engines.

Apple also has gotten a boost from its brand names becoming synonymous with products. The iPod, which was the first digital music player when it came out in 2001, is still the name people use for "digital music player" or "MP3 player." And it appears Apple's iPad is headed down the same path.

For consumers like Mary Schmidt, 58, the "iPad" is generic for "tablet." Schmidt, a Baltimore marketing executive, owns an iPad and doesn't know the names of any other tablets.

"When I think of tablets, I think of an iPad," she says. "I think it's going to be the generic name. They were first."

It remains to be seen if the iPad will maintain its name domination in the tablet market. Apple declined to comment for this article.

For now, Apple Inc. has a majority of the tablet category, which includes Amazon's Kindle Fire and Samsung Electronics Co.'s Galaxy Tablet. The iPad accounted for about 73 percent of the estimated 63.6 million tablets sold globally last year, according to research firm Gartner.

Apple's market share is likely to decline as more rivals roll out tablets. But experts say that won't necessarily diminish iPad's name recognition.

"Apple is actually pretty good at this," says Litman, the law school professor. "It's able to skate pretty close to the generics line while making it very clear the name is a trademark of the Apple version of this general category."

When the iPad debuted in 2010, some people offered up "Apple Tablet" or the "iTab" as better names. Others even suggested that the name sounded more like a feminine hygiene product than a tablet: "Get ready for Maxi pad jokes and lots of 'em!" wrote tech site Gizmo at the time.

Two years later, those complaints are all but forgotten.

"At the end of the day, the product was so successful that even if it wasn't the 'quote unquote' best name, it made the name synonymous with the category," says Allen Adamson, managing director at branding firm Landor.
