Court: Heart of gay marriage law unconstitutional

BOSTON (AP) ? A federal appeals court Thursday declared that the Defense of Marriage Act unconstitutionally denies federal benefits to married gay couples, a groundbreaking ruling all but certain to wind up before the U.S. Supreme Court.

In its unanimous decision, the three-judge panel of the 1st U.S. Circuit Court of Appeals in Boston said the 1996 law that defines marriage as a union between a man and a woman deprives gay couples of the rights and privileges granted to heterosexual couples.

The court didn't rule on the law's more politically combustible provision, which said states without same-sex marriage cannot be forced to recognize gay unions performed in states where it's legal. It also wasn't asked to address whether gay couples have a constitutional right to marry.

The law was passed at a time when it appeared Hawaii would legalize gay marriage. Since then, many states have instituted their own bans on gay marriage, while eight states have approved it, led by Massachusetts in 2004.

The court, the first federal appeals panel to deem the benefits section of the law unconstitutional, agreed with a lower level judge who ruled in 2010 that the law interferes with the right of a state to define marriage and denies married gay couples federal benefits given to heterosexual married couples, including the ability to file joint tax returns.

The 1st Circuit said its ruling wouldn't be enforced until the U.S. Supreme Court decides the case, meaning that same-sex married couples will not be eligible to receive the economic benefits denied by DOMA until the high court rules.

That's because the ruling only applies to states within the circuit, including Massachusetts, Rhode Island, Maine, New Hampshire and Puerto Rico. Only the Supreme Court has the final say in deciding whether a law passed by Congress is unconstitutional.

Although most Americans live in states where the law still is that marriage can only be the union of a man and a woman, the power to define marriage had always been left to the individual states before Congress passed DOMA, the appeals court said in its ruling.

"One virtue of federalism is that it permits this diversity of governance based on local choice, but this applies as well to the states that have chosen to legalize same-sex marriage," Judge Michael Boudin wrote for the court. "Under current Supreme Court authority, Congress' denial of federal benefits to same-sex couples lawfully married in Massachusetts has not been adequately supported by any permissible federal interest."

During arguments before the court last month, a lawyer for gay married couples said the law amounts to "across-the-board disrespect." The couples argued that the power to define and regulate marriage had been left to the states for more than 200 years before Congress passed DOMA.

An attorney defending the law argued that Congress had a rational basis for passing it in 1996, when opponents worried that states would be forced to recognize gay marriages performed elsewhere. The group said Congress wanted to preserve a traditional and uniform definition of marriage and has the power to define terms used to federal statutes to distribute federal benefits.

Since DOMA was passed in 1996, many states have instituted their own bans on gay marriage, while eight states have approved it, including Massachusetts, Connecticut, New York, Iowa, New Hampshire, Vermont, Maryland, Washington state and the District of Columbia. Maryland and Washington's laws are not yet in effect and may be subject to referendums.

Last year, President Barack Obama announced the U.S. Department of Justice would no longer defend the constitutionality of the law. After that, House Speaker John Boehner convened the Bipartisan Legal Advisory Group to defend it. The legal group argued the case before the appeals court.

Gay & Lesbian Advocates & Defenders, the Boston-based legal group that brought one of the lawsuits on behalf of gay married couples, said the law takes one group of legally married people and treats them as "a different class" by making them ineligible for benefits given to other married couples.

"We've been working on this issue for so many years, and for the court to acknowledge that yes, same-sex couples are legally married, just as any other couple, is fantastic and extraordinary," said Lee Swislow, GLAD's executive director.

Two of the three judges who decided the case Thursday were Republican appointees, while the other was a Democratic appointee. Boudin was appointed by President George H.W. Bush, while Judge Juan Torruella was appointed by President Ronald Reagan. Chief Judge Sandra Lynch is an appointee of President Bill Clinton.

Russian firm: Iran victim of another cyberattack

(AP) ? A Russian-based internet security firm says a powerful computer virus with unprecedented data-snatching capabilities has attacked machines in Iran and elsewhere in the Middle East.

Iran has not disclosed any damage done by the new spyware virus, dubbed "Flame." Its origin has not been identified, but Israel's vice premier fueled speculation that his country, known for its technological innovation and tireless campaign against Iran's suspect nuclear program, unleashed it.

Russian digital security provider Kaspersky Lab, which identified the virus, said in a release posted on its website late Monday that "the complexity and functionality of the newly discovered malicious program exceed those of all other cyber menaces known to date."

It said preliminary findings suggest the virus has been active since March 2010, but eluded detection because it of its "extreme complexity" and the fact that only selected computers are being targeted. Flame's primary purpose, it said, "appears to be cyber espionage, by stealing information from infected machines" and sending it to servers across the world.

According to Kaspersky, the virus collected information not only in Iran, but also in Israel and the Palestinian territories, Sudan, Syria, Lebanon, Saudi Arabia and Egypt. Iran, however, was far and away the country most affected, it said.

A unit of the Iranian communications and information technology ministry said only that it has produced an antivirus capable of identifying and removing the new malware. The Flame virus is the fourth known cyber attack on the Iranian nuclear program.

Comments Tuesday by Israel's vice premier did little to deflect suspicion about possible Israeli involvement in the latest attack.

"Whoever sees the Iranian threat as a significant threat is likely to take various steps, including these, to hobble it," Vice Premier Moshe Yaalon told Army Radio. "Israel is blessed with high technology, and we boast tools that open all sorts of opportunities for us."

Israel, like the West, rejects Tehran's claims that its nuclear program is designed to produce energy, not bombs. It considers Iran to be the greatest threat to its survival and repeatedly, if obliquely, threatened to attack Iran's nuclear facilities if Tehran doesn't abandon its uranium enrichment project, a key element of bombmaking.

Kaspersky said the cyber espionage worm came to its attention after the United Nations' International Telecommunication Union asked it for help in finding a piece of malware that was deleting sensitive information across the Middle East. The company stumbled across Flame when searching for that other code, it said.

Because Flame is so complex, was not designed to hack into bank accounts and doesn't have the hallmarks of amateur hackers, Kaspersky has concluded that the research that went into the code was government-sponsored.

The code offers no information that can tie Flame to any specific nation, Kaspersky said.

The first known cyber attack on the Iranian nuclear program dates back to 2010, when the Stuxnet virus disrupted controls of some nuclear centrifuges. Iran claims Stuxnet and other computer viruses have done no serious harm to Iran's nuclear or industrial facilities, and sees them as part of a campaign by Israel, the U.S. and their allies, which includes the assassination of Iranian nuclear scientists, to undermine the Iranian nuclear program.

In Baghdad last week, Iranian negotiators rejected proposals by six world powers to curb Tehran's nuclear ambitions. A new round of nuclear talks is expected to take place in Moscow next month.

Yaalon, the Israeli vice premier, told Army Radio on Tuesday that the talks in Iraq "yielded no significant achievement" except to let Iran buy time. He appeared to take a swipe at President Barack Obama by saying it might "even be in the interest of some players in the West to play for time."

Yaalon in the past expressed disappointment that the U.S. has delayed plans to expand sanctions against Iran, suggesting Washington was afraid the penalties would send oil prices soaring and hurt Obama's re-election chances.

The brother of blind activist Chen Guangcheng has gone missing, a lawyer said on Saturday, days after he fled his village in northeastern China to seek help for his son who has been detained in a case that has become a rallying point among rights activists.

Chen Guangfu, the eldest brother of Chen Guangcheng, fled his home in Shandong province and arrived in Beijing on Wednesday to seek legal help for his son, Chen Kegui, who is being held on an attempted murder charge.

He appears to have become the latest target of the government's reprisals against Chen Guangcheng's family in the wake of the blind activist's escape from his village in late April after 19 months of detention at home.

Chen Guangcheng took refuge in the U.S. embassy, where he stayed for six days and sparked a diplomatic crisis between China and the United States. That crisis, which overshadowed a visit by Secretary of State Hillary Clinton, was finally defused last Saturday when China allowed Chen to fly to the United States to study.

Chen Guangfu did not return to his hotel room in Beijing on Friday night, Shandong-based lawyer Liu Weiguo told Reuters.

Zhao Wei, a Shandong supporter of Chen Guangcheng's family, was the last person to have contact with Chen Guangfu before they parted ways on Friday afternoon, Liu said.

"As of now, there's still no news on Brother Guangfu," Liu said. "We're not optimistic. Guangcheng is also very worried. He's contacting friends to look (for him)."

The news of Chen Guangfu's disappearance comes three days after the 55-year-old farmer and odd job laborer recounted to Reuters details of his own torture and reprisals by authorities since his brother's escape. ?

The brother of blind activist Chen Guangcheng has gone missing, a lawyer said on Saturday, days after he fled his village in northeastern China to seek help for his son who has been detained in a case that has become a rallying point among rights activists.

Chen Guangfu, the eldest brother of Chen Guangcheng, fled his home in Shandong province and arrived in Beijing on Wednesday to seek legal help for his son, Chen Kegui, who is being held on an attempted murder charge.

He appears to have become the latest target of the government's reprisals against Chen Guangcheng's family in the wake of the blind activist's escape from his village in late April after 19 months of detention at home.

Chen Guangcheng took refuge in the U.S. embassy, where he stayed for six days and sparked a diplomatic crisis between China and the United States. Pol, Union Call for Passage of Transportation Bill


A Long Island congressman joined with a construction union leader to call for passage of a transportation bill that would fund road work projects in the region to improve safety and ease traffic congestion.

Rep. Steve Israel (D-Dix Hills) said the bill has fallen victim to congressional partisan gridlock in the Republican-controlled House of Representatives. He and Marc Herbst, executive director of the Long Island Contractors Association, held a news conference calling attention to the issue on the side of Jericho Turnpike, one of the roadways in need of improvements.

?Too many of my colleagues believe that the federal government ought to only repair certain roads in Texas, but not improve roads for middle class, suburban drivers in the suburbs in New York,? Israel said Friday, just as millions of drivers hit the roads for the Memorial Day weekend. ?There shouldn?t be ideology in road building.?

Israel said the long-term surface transportation reauthorization bill would create 500 jobs in Nassau and Suffolk counties but is in competition with a GOP version of the bill. The current transportation bill was recently extended but will expire at the end of next month.

The funding in the bill Israel touted would fix potholes on Jericho Turnpike, maintain the Meadowbrook and Southern State parkways, extend the lanes on the Long Island Expressway and add a bicycle lane in Oceanside.

Routes 110 and 112 would also be improved. These roads have a 12-year paving cycle as the surface deteriorate over time.

?They have scheduled in two years to repave Jericho Turnpike, but the federal dollars are not there to do the job, so the potholes and congestion will continue to grow,? Herbst said.

These certainly are alarming statistics. It is ironic that ETS, which stands for Educational Testing Services, is bemoaning the decline of civic engagement. While ETS is not nearly as objectionable as Pearson or Wireless Generation, it could be argued that the entire regime of standardized testing that ETS represents has helped along the disenfranchisement of the American citizen. The narrowing of the curriculum to which testing lends itself enables subjects like history, which should be studied and assessed as whole cloth, to be chopped up into isolated bits of trivia. This testing regime goes part of the way towards explaining why children lack civic knowledge

The narrowing that we see today threatens to do away with history as a subject altogether. One of the bromides of education reform is that schools need to prepare students for the 21st century economy, which promises to be a highly technological affair. This means stressing Science, Technology, Engineering and Math. ETS is rightfully concerned about the health of American democracy. Yet, the education reformers of today are more concerned with keeping the United States economically competitive. They have shown little regard for activating the American people as citizens. Rather, they are single-mindedly obsessed with activating the American people as the low-paid technological workforce of the future.

Part of this is nothing new. There was a wave of science and math education after the Soviet Union launched Sputnik in 1957. Our leaders believed the Russians were beating us technologically during the Cold War. Not to be outdone, President Kennedy promised to land a man on the moon by the end of the 1960s by riding a spate of investment in STEM education.

There was a major difference between that wave of STEM and the current wave. When the first people landed on the moon, they planted an American flag because it was the culmination of a civic exercise. The resources of an entire nation had been working towards that moment. It may have been ?one giant leap for mankind?, but there was no doubt who out of mankind?s representatives took the credit for that leap: those that lived under the Stars and Stripes. In short, we invested in STEM as a civic exercise.

Today, the justification for STEM education is naked economic interest. We must be able to keep up with our global competitors not as a matter of civic pride, but because we are in danger of losing our spot in the marketplace. There is no talk anymore of producing the next generation of astronauts. Astronauts were intergalactic conquistadors working in the service of a country; a country that was advancing knowledge for all mankind. Today, we tell kids to study STEM because the economy of tomorrow demands it. There is no purpose other than the profit motive.

History and civics were necessary to produce astronauts. Even if the version of America that children learned was sanitized, at least there was the idea that America was worth knowing. People had to have an idea of what that flag on the moon represented.

On the other hand, history and civics is irrelevant in the global marketplace. Business today knows no borders. Products, capital and labor cross national boundaries with ease. In fact, allowing future generations to imbibe the lessons of freedom and justice that come with any sanitized reading of American history might make the low-paid functionaries of tomorrow less than compliant. There is no place for civics in the current Neoliberal regime of education reform. The only subjects worthy of study are the equations and formulas of STEM. The only way to measure learning is the bloodless data of high-stakes testing. The only purpose behind this effort is cold economic calculation.

So, while history is still a core subject in most American schools, it is a subject that is devalued in the sterilized world of education reform.

This leads us to other reasons why the civic spirit is lacking in American children. While it is a cause for concern that less than a third of schoolchildren know about the Constitution or the Supreme Court, it is safe to say that the proportion of adults who know these things is not much higher.

To a great extent, the United States has always been an anti-intellectual place. On the other hand, the era in which we currently live marries good old American anti-intellectualism to widespread Gen X apathy.

Since the 1970s, it has become the norm for voter turnout to hover around 50% even for presidential elections. Congressional and local races are generally much lower. A change happened during that nervous decade. The Pentagon Papers, Watergate and the increasing vulgarity of popular culture gave rise to widespread cynicism among the electorate. All leaders were bums. All politicians were the same. It did not matter which politician?s slop the electorate eats up, for it all winds up the same flavor in the end.

To a great extent, the cynicism in the electorate gets at something real. No matter how well-liked a politician is, there is always the understanding that we are being gamed. Bill Clinton left office with high approval ratings, yet by that time he had already proven to be a philanderer who had committed perjury. His moniker of ?Slick Willie? was almost an endearing term. He was the slimy politician that Americans loved to love.

Contrast the benign ?Slick Willie? to Richard Nixon?s dark nickname of ?Tricky Dick?. By the time he left office, ?Tricky Dick? was a term of derision. Nixon was the slimy politician that Americans loved to hate. This is because ?Tricky Dick? came from a generation of American citizens who expected more out of their government than they do now. Many people may not have voted for the POTUS, but he was still everyone?s POTUS and deserved respect. People had faith in their government. They were civically engaged.

So America?s children can be forgiven if they do not know about the Constitution or the Supreme Court. Adults tend to only know these things as broken promises. The most enlightened among the electorate know them as noble experiments of a genteel age that have been betrayed by a generation of self-seekers and social climbers. It is not that American adults are ignorant of these things; it is that they have an instinctive mistrust of what they have become.

Is it any wonder that America?s children, who can pick up so readily on the unspoken assumptions of the adults around them, betray the same lack of civic spirit the electorate as a whole demonstrates?

How can we revive the civic spirit? It will not come with more high-stakes tests, even if those tests are in civics. It will not come with new curriculum or new project-based methods of teaching civics. It will not come with making American history and government a double period class in the fashion that math and science have labs.

No, reviving the civic spirit in children will only be possible once it is revived in the adults. There used to be a time when the government exercised its power of public domain over the television airwaves to cover issues of public moment. There used to be a time when the reporters actually investigated instead of accepting the words of politicians and business leaders at face value. There was a time when Americans tuned in to see their astronauts launch into outer space.

Today, all we have on the television is Snookie?s pregnancy or the Kardashians? bad hair day. All we have in the papers is partisan yellow journalism.

There was a time when a person (albeit, usually a white man) would be able to work for the same corporation for 30 years and then live off a decent pension in old age, supplemented by Social Security. There was a time when Americans felt as if they were getting ahead, before the age of credit cards and debt slavery. There was a time when, with government help, parents would be able to put their kids through college to get the education that was going to improve the life of the next generation.

Today, Americans move from one low-paying job to another. Creditors call their houses seven days a week to remind them of how behind they really are. A college education is no longer the magic bullet for intergenerational progress.

All the while, politicians are telling everyone that things are fine. The economy is always improving, or always on the verge of improving. The Dow Jones is up. Business leaders see bright days ahead if we just give them another tax cut and tighten our belts a little bit longer.

Americans have lost stock in America. Our children sense this and know better than to put any stock in it in the first place.

WASHINGTON U.- ST. LOUIS (US) ? A less invasive screening test for colorectal cancer reduces deaths from the disease but is probably not as effective as colonoscopy, new research shows.

Scientists found that screening with sigmoidoscopy reduced overall colorectal cancer deaths by 26 percent and new cases by 21 percent, when compared to no screening.

The nearly 20-year study involved 154,900 patients at major centers nationwide, including about 17,000 at Washington University School of Medicine in St. Louis. Results were published online May 21 in the New England Journal of Medicine.

No studies have compared mortality outcomes between sigmoidoscopy and colonoscopy. But recent research showed that colonoscopy reduced colorectal cancer deaths by 53 percent, making it the preferred screening method, says Nicholas O. Davidson, director of the Division of Gastroenterology.

But sigmoidoscopy is a valid option if its less invasive nature and easier preparation prompt more people to be screened, he adds. No matter how pre-cancerous polyps are detected, their removal reduces colorectal cancer risk.

?These findings provide further evidence that regular, scheduled screening is effective in decreasing the incidence of colorectal cancer and mortality from this disease,? says Davidson, who sees patients at the Alvin J. Siteman Cancer Center at Barnes-Jewish Hospital and Washington University School of Medicine.

?Taken together with findings published earlier this year from the results of screening colonoscopy, the new research strongly suggests that colorectal cancer deaths are preventable through aggressive screening programs.?

Sigmoidoscopy uses a thin, flexible tube-like instrument, called a sigmoidoscope, to view the anus, rectum, and lower colon. People who opt for this screening test don?t need to undergo rigorous bowel preparation, which is required for colonoscopy and is one reason that many people avoid the test.

Sigmoidoscopy also poses a lower risk of bowel perforation (an uncommon event that occurs when the scope pokes a hole in the intestine) compared to colonoscopy, in which a similarly flexible, but longer, tube is used to view the entire colon.

Researchers estimate that if they had used colonoscopy rather than sigmoidoscopy in the study, they would have identified 16 percent more cancers. But they concede that screening with sigmoidoscopy is better than no screening at all.

Colorectal cancer is the second-leading cause of cancer-related death in the U.S. Previous research has shown that colorectal cancer cases and deaths can be reduced with a number of screening methods, including a third one called fecal occult blood testing. However, flexible sigmoidoscopy and colonoscopy are more sensitive than the blood test for detecting polyps that may lead to colorectal cancer.

The National Cancer Institute (NCI) funded the new research, part of the Prostate, Lung, Colorectal and Ovarian (PLCO) Cancer Screening Trial, at 11 sites across the U.S. The study involved men and women aged 55 through 74 who were randomly assigned to receive flexible sigmoidoscopy screening or usual care. People in the usual care group only received screening if they asked for it or if their physician recommended it.

Participants in the flexible sigmoidoscopy group were screened once on entering the study and again three years to five years later. The participants were followed for approximately 12 years to collect data on cancer diagnoses and deaths.

Overall, after an average of nearly 12 years, participants in the screening group had a 21 percent lower incidence of colorectal cancer overall and a 26 percent lower rate of colorectal cancer mortality than participants in the usual care group.

This means that, over the course of 10 years, if 1,000 people received two sigmoidoscopy screenings, there would be approximately three fewer new cases and one fewer death from colorectal cancer than in a comparable group not receiving regular screenings.

?This is the second major trial that has shown that sigmoidoscopy is effective in reducing the risk of dying of colorectal cancer,? says Barnett Kramer, director of NCI?s Division of Cancer Prevention.

?Sigmoidoscopy is less invasive than colonoscopy and carries a lower risk of the colon being perforated, which may make it more acceptable as a screening test to some patients. There are several effective screening tests for colorectal cancer, and the most effective screening test is the one that people choose to take.?

At the School of Medicine, the PLCO trial is led by Gerald Andriole, the chief of urologic surgery at the Alvin J. Siteman Cancer Center at Barnes-Jewish Hospital and Washington University School of Medicine.
